These Terms and Conditions ("Terms") govern your access to and use of the Inkspire mobile application (the "App"), this website (the "Site", together with the App, the "Services") and related features offered by Inkspire("we", "us" or "our").

By creating an account, downloading or using the App, visiting the Site, or otherwise using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

These Terms are intended to comply with applicable European Union law, including consumer protection rules where they apply to you, Regulation (EU) 2016/679 ("GDPR"), and the laws of the Republic of Bulgaria, including the Bulgarian Personal Data Protection Act ("PDPA") where relevant to our relationship with you.

1. Other documents

Our Privacy Policy explains how we collect and use personal data when you use the Services. It forms part of your relationship with us and should be read together with these Terms.

2. Eligibility

The Services are not directed at children under the age of 16. By using the Services, you confirm that you are at least 16 years old, or that you have reached the minimum age required in your country to enter into a binding agreement with us, whichever is higher. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Accounts and authentication

Certain features require an Inkspire account. You may sign in using methods we support (such as email one-time password, Sign in with Apple or Sign in with Google), as described in our Privacy Policy.

  • You must provide accurate information and keep your account details up to date where applicable.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account, except where unauthorised use results from a failure on our side that we could not reasonably have prevented.
  • You must notify us promptly at support@inkspire-app.com if you suspect unauthorised access to your account.

4. Description of the Services

Inkspire offers a digital reading experience, including discovery of stories, immersive reading features, a personal library, reading progress and related functionality in the App, and information about the product on the Site. We may add, change or discontinue features over time, provided that we respect your statutory rights as a consumer where applicable.

5. Subscriptions and payments

The App offers paid subscription plans distributed through the Apple App Store and Google Play Store. We use RevenueCat to implement and manage in-app subscriptions (including validating purchases and subscription status with Apple and Google), as further described in our Privacy Policy.

  • Paid subscriptions are contracted with Apple or Google under their respective terms. Billing, renewal, cancellation and refunds are handled in accordance with the applicable store policies.
  • We do not receive or store your payment card details. Apple and Google process payment data on their own systems.
  • We may change subscription products, prices and availability in line with applicable law and store rules. Where advance notice is required by law for existing subscribers, we will comply with those requirements.

6. Licence to use the Services

Subject to these Terms and applicable law, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to access and use the Services for your own non-commercial entertainment and reading, in accordance with any technical or usage limits we communicate to you.

You must not:

  • copy, modify, distribute, sell or lease any part of the Services or included content except as expressly permitted by us or by law;
  • attempt to gain unauthorised access to the Services, other users' accounts, or our or our providers' systems;
  • use the Services in a way that violates applicable law, infringes third-party rights, or could harm us, other users, or the security or stability of the Services;
  • use automated means to access the Services in a manner that places an unreasonable load on our infrastructure or circumvents access controls, except where such restriction is not permitted under mandatory law.

7. Intellectual property

The Services, including software, branding, design, text, graphics, stories and other content made available by us (excluding content licensed from third parties where indicated), are owned by Inkspire or our licensors and are protected by copyright, trade mark and other intellectual property laws. Except for the limited licence in Section 6, no rights are granted to you.

If you submit feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free licence to use that feedback to operate and improve the Services without obligation to you, except where mandatory law provides otherwise.

8. Third-party services

The Services rely on or link to third parties (for example Apple, Google, cloud infrastructure, subscription tooling and diagnostics providers). Their services are subject to their own terms and privacy notices. We are not responsible for third-party services outside our reasonable control, except where mandatory consumer law provides otherwise.

9. Availability and changes

We aim to offer the Services with reasonable care and skill. The Services are provided over the internet and mobile networks; we do not guarantee uninterrupted or error-free operation. We may suspend the Services for maintenance, security or legal reasons, or modify features where justified.

We may update these Terms to reflect changes in the Services, our practices or applicable law. The updated version will be indicated by an updated "Last updated" date. Where changes are material and we are required to notify you under applicable law, we will do so by appropriate means (for example in the App or by email). Your continued use of the Services after the effective date of changes may constitute acceptance, where permitted by law.

10. Term and termination

These Terms apply for as long as you use the Services. You may stop using the Services at any time and may request deletion of your account in line with our Privacy Policy.

We may suspend or terminate your access if you materially breach these Terms, if we are required to do so by law, or if we reasonably need to do so to protect the security or integrity of the Services or other users. Where feasible, we will give you notice and an opportunity to remedy the breach unless immediate action is necessary.

Provisions that by their nature should survive (including intellectual property, limitation of liability where permitted, and governing law) will remain in effect after termination.

11. Warranty and disclaimer

To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available". Except as expressly stated in these Terms or required by mandatory law, we disclaim all warranties and conditions, whether express, implied or statutory, including implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement, in each case only where such exclusion is lawful.

12. Limitation of liability

Nothing in these Terms excludes or limits our liability where such exclusion or limitation would be unlawful, including for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under applicable mandatory law.

Subject to the preceding paragraph and to the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data, arising out of or in connection with your use of the Services.

Subject to the first paragraph of this section, our total aggregate liability arising out of or in connection with these Terms or the Services in any twelve-month period is limited to the greater of (a) one hundred (100) EUR and (b) the amounts you have paid to us directly for the Services in that period (excluding amounts paid to Apple or Google for subscriptions). If you have not paid us directly in that period, the cap in (b) is zero and only (a) applies, where such a cap is permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict-of-law rules that would cause another law to apply, except that if you are a consumer habitually resident in the European Economic Area or the United Kingdom, you also benefit from any mandatory provisions of the law of your country of residence that cannot be waived by contract.

If you are a consumer, you may bring proceedings against us in the courts of your place of residence or in Bulgaria. We may bring proceedings against you in the courts of your place of residence if you are a consumer, or otherwise in the competent courts of Bulgaria.

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obliged to use a specific alternative dispute resolution entity, but we will consider good-faith requests to resolve disputes amicably.

14. General

  • Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services, subject to mandatory law.
  • No waiver. Failure to enforce any provision is not a waiver of our rights.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets, provided that your statutory rights are preserved.
  • Language. These Terms are provided in English. If we provide a translation, the English version prevails in case of inconsistency, except where mandatory local law requires otherwise.
